1. Agreement to Terms
By accessing or using the services provided by Varrotek LLC ("Varrotek," "we," "us," or "our"), including our website at varrotek.com and any related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
2. Services
Varrotek provides professional drone services including but not limited to aerial photography, aerial videography, and real estate drone packages. All drone operations are conducted by an FAA Part 107 certified remote pilot in compliance with federal, state, and local regulations.
3. Service Agreements
Individual service engagements are governed by separate quotes and/or contracts provided prior to the commencement of work. These Terms of Service apply generally to your use of our website and interaction with our business. In the event of a conflict between these Terms and a specific service agreement, the service agreement shall prevail.
4. Scheduling and Cancellations
All drone flights are subject to weather conditions, airspace restrictions, and regulatory requirements. Varrotek reserves the right to reschedule or cancel any flight for safety reasons, including but not limited to adverse weather, active NOTAMs (Notices to Air Missions), TFRs (Temporary Flight Restrictions), or equipment concerns. Clients will be notified promptly of any schedule changes.
Cancellations by the client with less than 24 hours notice may be subject to a cancellation fee as outlined in the applicable service agreement.
5. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Varrotek LLC and is protected by applicable intellectual property laws. Drone footage and photographs delivered to clients are subject to the licensing terms specified in the applicable service agreement.
6. Client Responsibilities
Clients engaging Varrotek for drone services agree to:
- Provide accurate information about the service location and requirements
- Obtain any necessary property owner permissions for the flight location
- Sign required liability waivers prior to the commencement of services
- Not interfere with drone operations or the remote pilot's authority during flights
7. Limitation of Liability
To the maximum extent permitted by law, Varrotek LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services or website. Our total liability for any claim shall not exceed the amount paid by the client for the specific service giving rise to the claim.
8. Insurance
Varrotek carries appropriate liability insurance for commercial drone operations. Specific coverage details and certificates of insurance (COI) are available upon request and may be provided as part of individual service agreements.
9. Regulatory Compliance
All Varrotek drone operations are conducted in compliance with FAA Part 107 regulations, Florida state drone laws (FL Stat. 934.50, FL Stat. 330.41), and applicable local ordinances. Varrotek maintains current FAA Remote Pilot Certificates and aircraft registrations for all equipment used in commercial operations.
10. Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of the State of Florida.
12. Changes to Terms
Varrotek reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the revised terms.
